Dino Dig Crew: Fossil Blast
These Terms of Service ("Terms") are an agreement between you and Jones & Sons Apps LLC ("we," "us" or "our") covering your use of the Dino Dig Crew: Fossil Blast mobile game and its related services (the "Game"). By downloading, installing or playing the Game, you agree to these Terms. If you do not agree, please do not use the Game.
1.Who can play
The Game is for ages 13 and up. If you are under 18, or under the age of majority where you live, please review these Terms with a parent or guardian. Parents and guardians are responsible for their children's use of the Game, including any purchases.
2.License to use the Game
We give you a personal, limited, non-exclusive, non-transferable, revocable license to download and play the Game on devices you own or control, for your personal, non-commercial entertainment. You may not copy, modify, distribute, sell, rent, reverse engineer or create derivative works from the Game, except as allowed by law.
3.Virtual items and purchases
- The Game includes virtual items such as coins, boosters, lives, bundles, the Crew Pass and the Treasure Sack ("Virtual Items"). Some can be earned through play and some can be bought with real money.
- Virtual Items have no real-world cash value. They cannot be exchanged for money and cannot be transferred or sold to anyone else.
- When you buy Virtual Items, you receive a limited license to use them in the Game. You do not own them.
- All purchases are processed by Google Play or Apple's App Store and follow their payment and refund policies. Refund requests must be made through the store where you made the purchase. Except where required by law, purchases are final and non-refundable.
- We may change, rebalance or remove Virtual Items, prices or game features at any time. If the Game is discontinued, unused Virtual Items may be lost, except where the law requires otherwise.
- To prevent purchases you didn't intend, you can turn off or require approval for in-app purchases in your device or store settings.
4.Accounts, progress and sign-in
You can play without signing in. If you choose to sign in with your email address (optional cloud save), your progress is saved online so you can restore it on another phone. You are responsible for keeping your device and email account secure. We are not responsible for progress lost because of device loss, uninstalling the Game without signing in, or problems with your email service, but we will try to help where we reasonably can. 5.Leaderboards, crews and player names
Some features, such as leaderboards, friends lists, crews, digger names and avatars, are visible to other players. Digger names are picked from a fixed list of words and crew chat uses preset phrases. You agree not to use these features to harass, mislead or impersonate anyone. We may change names, remove players from leaderboards or crews, or limit access to features if these rules are broken.
6.Fair play
You agree not to cheat, exploit bugs, use bots, hacks or unauthorized software, tamper with the Game or its servers, or interfere with other players' enjoyment. We may reset progress, remove Virtual Items obtained unfairly, or suspend access to the Game if we believe these rules have been broken.
7.Updates and availability
We may update the Game from time to time, including automatic content updates, to add features, fix problems or improve the Game. Some updates may be required to keep playing. We do not guarantee that the Game or any feature will always be available, uninterrupted or error-free, and we may change or discontinue the Game at any time.
8.Privacy
Your privacy matters to us. Please read the Dino Dig Crew Privacy Policy to learn what information we collect and how we use it. The Game does not show ads.
9.Our intellectual property
The Game and everything in it, including its name, characters (such as Tuff and the Dino Dig Crew), artwork, music, sounds, text, levels and software, is owned by Jones & Sons Apps LLC or its licensors and is protected by copyright, trademark and other laws. Nothing in these Terms gives you any rights to our intellectual property except the limited license above.
10.Disclaimers
The Game is provided "as is" and "as available." To the fullest extent allowed by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement.
11.Limitation of liability
To the fullest extent allowed by law, Jones & Sons Apps LLC will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of data, progress or Virtual Items, arising from your use of the Game. Our total liability for any claim related to the Game will not exceed the amount you paid us in the 12 months before the claim, or $50, whichever is greater. Some places do not allow these limits, so they may not apply to you.
12.Apple and Google
If you downloaded the Game from Google Play, Google Play's Terms of Service also apply. If you downloaded the Game from the Apple App Store, you also agree to Apple's Licensed Application End User License Agreement, and Apple is not responsible for the Game or its support. Apple and Google are not parties to these Terms. If there is a conflict between these Terms and the store's terms, the store's terms control to the extent required.
13.Ending these Terms
You can stop using the Game at any time by deleting it. We may suspend or end your access if you break these Terms. Sections 3 (no cash value), 9, 10, 11 and 14 continue to apply after these Terms end.
14.Governing law
These Terms are governed by the laws of the State of Alabama, United States, without regard to its conflict-of-law rules. Nothing in these Terms takes away rights you have under the consumer protection laws of the country where you live.
15.Changes to these Terms
We may update these Terms from time to time. When we do, we will update the effective date above, and for important changes we may also notify you in the Game. If you keep playing after changes take effect, you accept the updated Terms.
